1.00 Standard CLE Credit - This presentation will explore civil law and substitute decision making tools as they intersect criminal prosecutions, particularly in cases of elder abuse. Older and vulnerable adults often have substitute or supported decision making tools or documents in place that are defined by law (and in some cases, court-supervised). Understanding these fiduciary and/or decision making tools and roles, their structures and uses, the legal capacity required to create substitute decision making arrangements, and the manner in which these agreements can be terminated can be useful information for prosecutors and law enforcement working with older victims of crime. We will explore the structures, uses and interactions of various substitute decision making documents including Power of Attorney, Health Care Directives, POLST, Guardianship and Conservatorship, and discuss supported decision making in this webinar.
